Terms of Use (TOU) – WizeTrip
These Terms of Use (hereinafter “TOU”) govern the use of the WizeTrip mobile application, published by WIZETRIP CORPORATE, a sole proprietorship registered at 350 Avenue Jean René Guillibert Gauthier de la Lauzière, 38 Parc Club du Golf, 13100 Aix-en-Provence, France.

The user acknowledges having read, understood, and accepted these TOU prior to any use of the application.
Article 1 Purpose
The purpose of these TOU is to define the terms and conditions governing the use of the WizeTrip application. The application notably allows users to :
• Access AI-powered travel itinerary planning services ;
• Access additional and exclusive services (AI credits, Premium subscriptions, itinerary downloads, and the upcoming WizeBox).

Article 2 Account Creation
To access certain features, the user must create a personal account and provide accurate information :
• First name, email, date of birth, place of residence, password.
The user agrees to keep this information up to date and not to use false or misleading
information.

Article 3 Credits and Subscriptions
3.1 Credit System
- The application offers a credit-based system for generating itineraries: 10 credits = 1 itinerary.
- Upon registration, the user is granted 10 free credits.
- To access additional features and monthly credits, the user may subscribe to a Premium plan, consisting of three subscription tiers: Discovery, Explorer, and Traveler, each including exclusive features represented by locked content.
- 10 credits = 1 itinerary.
Credits are non-transferable and non-cumulative. The credit balance is reset each month on the subscription anniversary date. Unused credits are forfeited at the end of each monthly period.
3.2 Subscriptions
WizeTrip Passes are single-payment subscription plans providing access to various features of the application. Each subscription is entered into for the duration and under the conditions specified at the time of purchase.

EXPLORER PASS
€9.99/month for 12 months, billed as a single payment of €119.88
- 60 credits + 40 bonus credits = 100 credits per month
- Activity modifications included
- PDF download of itineraries
- Access to more exclusive itineraries
- Increased activity suggestions
- Option to purchase additional credits
Purchase of Additional Credits
- 20 credits: €5.99
- 50 credits: €12.99
- 100 credits: €19.99
Additional credits may be purchased at any time and remain valid for the duration of the active subscription.
Service and Price Changes
WizeTrip reserves the right to modify, at any time, its products, services, subscription plans, and pricing conditions. Any changes will be published within the application and/or on the official website and will apply only to new subscriptions entered into after such publication.
For existing subscribers, any material modification of services or price changes will be communicated in writing (by email or in-app notification) at least 30 days prior to their effective date.
In the event of disagreement, the user may terminate the subscription without charge prior to the application of the new conditions. Failing such termination within the specified timeframe, the new conditions shall be deemed accepted and shall automatically apply to the ongoing subscription.
3.3 Automatic Renewal and Billing
Premium subscriptions and additional credit purchases are payable exclusively through the Apple App Store or Google Play Store and are processed as single payments.
Payments are made in accordance with the terms and conditions of these platforms, including the automatic renewal of subscriptions on the subscription anniversary date. WizeTrip does not store any banking information and does not intervene in the payment process.
- All prices indicated include all applicable taxes (including VAT and any applicable fees).
- All subscriptions are automatically renewed at the end of each billing period unless cancelled at least 24 hours prior to the renewal date.
- Your Apple ID or Google Play account will be charged upon confirmation of purchase.
- Subscriptions may be managed and automatic renewal may be disabled in the account settings of your device after purchase.

3.4 Cancellation :
- You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings.
- Cancellation must be completed at least 24 hours before the next billing cycle to avoid being charged.
- No refunds are provided for partially used subscription periods.
Ongoing subscriptions will not be refunded for any period already consumed.

Article 4 – Payment Terms via Apple and Google
Premium subscriptions are offered exclusively through the Apple App Store and the Google Play Store and are processed as single payments.
Accordingly:
- Premium subscriptions are processed via the Apple App Store and Google Play Store. By subscribing:
- You authorize Apple and/or Google to charge your account at the price displayed at the time of purchase;
- Subscriptions are automatically renewed unless cancelled at least 24 hours before the end of the current period;
- Renewal charges are applied within 24 hours prior to the end of the current subscription period.
- Any refund request must be submitted directly to Apple or Google, as WizeTrip is unable to process refunds
- Payment terms are governed by the respective terms and conditions of Apple and Google.
Article 4 Payment via Apple and Google
Premium subscriptions are offered exclusively through the Apple App Store and Google Play
Store and are processed via a one-off payment. Accordingly:
- Payment, billing, and renewal conditions are governed by the rules of these platforms
- WizeTrip has no access to users’ banking data and cannot intervene in the payment process ;
- Any refund request, dispute, or technical issue relating to payment must be
addressed directly to Apple or Google ; - Subscriptions renew automatically on the anniversary date of the initial purchase;
- The user acknowledges having read and accepted Apple’s and Google’s general
terms at the time of purchase.

Article 5 Right of Withdrawal
In accordance with the French Consumer Code (Articles L221-18 to L221-28) :
- The user has 14 days to exercise their right of withdrawal for unused services ;
- If the user begins using the application immediately after purchase (e.g., itinerary generation, credit consumption), they expressly waive their right of withdrawal for these digital services ;
- For the physical WizeBox, the right of withdrawal applies under the applicable
consumer law provisions.
Article 6 Intellectual Property
- The name, logo, source code of the application, visuals, and generated content are protected under copyright and/or industrial property rights.
- Any unauthorized reproduction, distribution, or exploitation is strictly prohibited ;
- The user is granted a personal, non-commercial right of use only;
- The WizeTrip trademark has been registered with the INPI (French National Institute of Industrial Property).

Article 7 Liability
WizeTrip takes all necessary measures to ensure the proper functioning of the application.
However, WizeTrip cannot be held liable for :
- Temporary service interruptions due to maintenance or technical issues beyond its control ;
- The absolute accuracy of AI-generated itineraries, which are based on user-provided information ;
- Any damage resulting from improper use of the application by the user.
In any case, WizeTrip’s liability is limited to the amounts actually paid by the user for the ongoing subscription.

Article 8 Account Suspension and Termination
WizeTrip reserves the right to suspend or delete a user’s account in cases of :
• Breach of these TOU ;
• Fraudulent use of the application ;
• Conduct infringing upon the rights or reputation of third parties.

Article 9 Personal Data
• Personal data collected is processed in accordance with WizeTrip’s Privacy Policy
and the GDPR.
• Users have the right to access, rectify, and delete their personal data.

Article 10 Governing Law and Jurisdiction
• These TOU are governed by French law;
• Any dispute relating to their interpretation or performance shall fall under the
exclusive jurisdiction of the courts of Aix-en-Provence or Paris, unless otherwise
required by mandatory legal provisions.
